No More IRS Outsourcing to Private Companies

CONGRESSWOMAN SHELLEY BERKLEY (D-NV) today [October 10, 2007] voted to repeal the use of private debt collection companies to collect Federal income taxes. The House passed H.R. 3056, The Tax Collection Responsibility Act of 2007, this afternoon on a vote of 232 to 173.

“This bill prevents the IRS from hiring private companies to collect federal income taxes and ends the use of this practice which has subjected Americans to intimidation and abuse. These private debt collectors have proven that they are poorly equipped to handle the job and this change will also protect taxpayer privacy by ending these contracts with outside companies. This package also postpones an unfair withholding requirement on government payments to vendors that will cause significant administrative and financial burdens on local governments. Clark County alone spends more than $100 million per year on vendor products and services. If this new requirement were allowed to take effect, Clark County would be required to withhold three percent of payments to businesses, which could result in cash flow problems and higher prices for consumers. Our bill postpones this requirement in order to give the Treasury Department time to study the impact of this provision on local governments and taxpayers,” said Berkley.

The legislation delays the application of an onerous three percent withholding requirement on government payments. Additionally, it addresses individuals who renounce their U.S. citizenship to avoid paying taxes and increases penalties for failing to file certain returns.

As a member of the powerful House Committee on Ways and Means, Berkley helped to spotlight issues involving the use of private debt collectors to collect Federal tax revenues. During a hearing in May, witnesses—including the Internal Revenue Service (IRS) Commissioner—concluded that the IRS could collect unpaid Federal taxes more efficiently than private debt collectors. Testimony was also presented putting a spotlight on aggressive tactics employed by some of the private firms that taxpayers said were harassment.

The bill is supported by a broad array of organizations, including Consumer Federation of America, National Consumer Law Center, National Consumers League, NAACP, National Council of La Raza, Citizens for Tax Justice, National Treasury Employees Union, and American Federation of State, County, and Municipal Employees.
