Emergency
minimum wage regulations go into effect
Nevada
Governor Kenny C. Guinn yesterday signed emergency regulations
to clarify the recent constitutional changes to minimum wage and
overtime. The regulations went into effect December 12. Under
Nevada law, emergency regulations can only be in effect for 120
days.
Nevada Labor
Commissioner Michael Tanchek determined a need for the emergency
regulations after receiving numerous inquiries from employers
all over the country as to specific interpretations of the
constitutional amendment, which went into effect November 28th.
Last week,
Tanchek held a public workshop to allow for further public
commentary on a draft of the emergency regulations, before
submitting the final for the governor’s signature.
“I wanted to
ensure that employers had an understanding of what the emergency
regulations would mean to them and have input on their
applicability in the real world,” Tanchek said.
The major
issues clarified though the emergency regulations are exceptions
to minimum wage; the definition of “health care,” calculating
income and premiums paid; and complying with daily overtime.
Tanchek will
conduct further workshops and hearings on minimum wage and other
issues starting in January, in order to have replacement
regulations in place when the emergency regulations expire in
April.
